1. Introduction

Zyqual Ltd. ("Zyqual", "we", "our", "us") is committed to protecting the privacy of the educators, administrators, students, and families whose data passes through our platform. This Privacy Policy explains how we collect, use, store, disclose, and protect personal information across Zyqual and our companion products (ZyAi and ZyqualSMS). It applies to every user of the platform and every visitor to our websites.

By creating an account or using the platform, you agree to the practices described in this Policy. If you do not agree, please do not use the platform.

2. Who We Are

Zyqual Ltd. is an education technology company headquartered in Jamaica. Zyqual operates in partnership with the Ministry of Education and Youth to provide quality-assurance, observation, appraisal, and professional-development tools to Jamaican educational institutions.

3. Information We Collect

We collect the following categories of information:

  • Registration & Account Data: full name, official Ministry of Education email address, phone number, TRN where required, school or institution affiliation, job role, parish, and region.
  • Profile Data: qualifications, subjects and grades taught, teaching certifications, and professional development records you choose to add.
  • Education & Observation Data: lesson observations, appraisal responses, SWOT submissions, IPDPs, student IEPs, attendance, enrolment records, and other records entered by authorised users.
  • Usage & Device Data: pages visited, features used, timestamps, IP address, browser and operating system, and diagnostic logs used to detect errors or abuse.
  • Communications: the content of messages you send us through support, contact forms, or newsletter subscriptions.

4. How We Use Your Information

We use your information to:

  • Provide, maintain, and improve the Zyqual platform and related services
  • Process registrations, verify identity, and manage account access
  • Generate observation, appraisal, and analytics reports for authorised users
  • Share anonymised regional and national indicators with the Ministry of Education and Youth
  • Communicate with you about your account, security, or platform updates
  • Respond to support requests and customer feedback
  • Detect, prevent, and respond to security incidents, fraud, or misuse
  • Comply with legal obligations under Jamaican law

5. Legal Basis for Processing

We process personal data on the following bases: your consent (for example, when you subscribe to our newsletter); the performance of a contract (providing you access to Zyqual); compliance with a legal obligation; and our legitimate interest in operating, improving, and securing the platform.

6. Data Sharing & Disclosure

We do not sell your personal information. We share data only in the circumstances below:

  • With the Ministry of Education and Youth (MoEY): as part of our partnership agreement for quality-assurance and national planning, strictly for educational purposes.
  • Within your institution: observation, appraisal, and IEP records are visible to authorised colleagues, supervisors, and regional or parish officers in accordance with role-based access rules.
  • With service providers: trusted vendors who host our infrastructure, send transactional email, or process payments, under contractual confidentiality and data-protection obligations.
  • When legally required: to comply with a lawful order, court request, or to protect the rights, safety, or property of Zyqual or others.

7. Data Protection & Security

We apply industry-standard safeguards including TLS encryption in transit, encryption at rest for sensitive data, role-based access controls, multi-factor authentication for privileged accounts, audit logging, and regular security reviews. No system can be guaranteed 100% secure, so we encourage you to protect your account credentials and report any suspected compromise immediately.

8. Data Retention

We retain personal data for as long as you maintain an active account and for the retention periods required by Ministry of Education and Youth policies or Jamaican law. Inactive accounts may be archived or anonymised. You may request earlier deletion, subject to legal and educational record-keeping obligations.

9. Your Rights

You have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or incomplete information
  • Request deletion of your data, subject to retention requirements
  • Object to or restrict certain processing
  • Withdraw consent where processing is based on consent
  • Lodge a complaint with the relevant data-protection authority

10. Children & Student Data

Zyqual is designed for school staff. Student information (such as IEP data, attendance, or enrolment records) is entered by authorised educators on behalf of the school. Schools and the MoEY remain the data controllers of student records; Zyqual acts as a data processor. We do not permit students to create personal accounts directly.

12. International Transfers

Zyqual is hosted on infrastructure that may store or process data outside Jamaica. Where this occurs, we apply contractual and technical safeguards to ensure your data receives equivalent protection.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through an in-platform banner.
